1. Experimental status and permitted use
nexRef is software under active development and is supplied solely for evaluation, technical testing, demonstration, and non-clinical research. It must not be used in production or as part of any real-world patient-care workflow.
2. Not a medical device
nexRef is not a medical device, has not been certified or approved as one, and is not intended to diagnose, prevent, monitor, predict, prognose, treat, or alleviate any disease or medical condition. It must never be used to make or support a clinical decision or as a substitute for qualified professional judgment.
3. Function and data handling
nexRef converts and transfers data between user-configured interfaces, devices, APIs, NFC or serial connections, and workstation directories. Nexio does not receive or retain this transferred data. The data may nevertheless be processed temporarily on the workstation while a conversion or transfer is performed.
4. User responsibilities
The user is solely responsible for obtaining every required authorization and lawful basis, complying with applicable confidentiality and data-protection requirements, securing connected devices and destinations, maintaining backups, and independently verifying every result. Testing with synthetic or properly anonymized data is strongly recommended.
5. No warranty
The software is provided “as is” and “as available,” without any express or implied warranty as to operation, accuracy, availability, compatibility, security, error-free performance, merchantability, fitness for a particular purpose, or non-infringement. It may contain defects, produce incorrect results, interrupt transfers, or alter or corrupt data.
6. Assumption of risk
The user assumes all risks arising from the installation, configuration, testing, and use of nexRef. The software must be evaluated in an isolated and controlled environment. No input, transformation, output, or destination-system result may be relied upon without independent validation.
7. Limitation of liability
To the fullest extent permitted by applicable law, Nexio Sàrl and its directors, employees, contractors, and partners shall not be liable for loss or corruption of data, downtime, equipment damage, third-party claims, financial loss, or any direct, indirect, incidental, special, punitive, or consequential damage arising from nexRef or its unavailability. Liability that cannot lawfully be excluded remains unaffected.
8. Support, changes, and withdrawal
Nexio makes no commitment to provide support, fixes, updates, continued compatibility, or future availability. Nexio may modify, suspend, or withdraw nexRef or download access at any time without notice.
9. Personal access and redistribution
The download link is personal and must not be shared, published, sold, or transferred. Unless Nexio gives prior written permission, the software may not be redistributed, sublicensed, or made available to any third party.
10. Governing law and jurisdiction
This notice is governed by the substantive laws of Switzerland. Subject to any mandatory place of jurisdiction, the competent courts at the registered office of Nexio Sàrl shall have exclusive jurisdiction.
